THE MEDIATION REQUIREMENT
In Australia, mediation is a required step before taking parenting or property disputes to court, except in limited cases like family violence or urgent matters.
Mediation is a voluntary process that allows parties to have more control over the outcome of their dispute. The mediator is an impartial third party who facilitates discussions and encourages communication between the parties. Unlike court proceedings, where a judge imposes a decision, the parties control the outcome in mediation.
Our accredited mediators can issue s60I certificates, confirming your efforts to resolve the matter or noting exemptions. Whenever possible, we encourage negotiation first—helping you find solutions without the stress of litigation.

Kate O’Grady is a senior solicitor at Orbell Family Lawyers who is also an accredited mediator and Family Dispute Resolution Practitioner. She completed her mediation training at Bond University in 2021 and is capable of issuing Section 60(I) Certificates.
Kate charges $2,750 plus GST for a full day of mediation, which is 7 hours. Any additional hour is charged at $400 plus GST. The Mediation will take place at our Erina office located in the Platinum Building.

Mediation is a cost-effective option as it usually costs considerably less than going to court. The time it takes to resolve a dispute through mediation is also much shorter than a traditional court case. In fact, most mediations are concluded or settled within thirty days from initiating the process, which can save parties a great deal of time and money.
Mediation is a flexible process that allows parties to create a resolution that is tailored to their specific needs and circumstances, rather than being bound by a court's decision. This means that the parties have more control over the outcome of the dispute, and can reach a mutually agreed-upon resolution. Mediation also gives the parties the opportunity to maintain a better relationship in the long term, especially when children are involved. Mediation can help them to co-parent and communicate more effectively.
Mediation statistically settles over 85% of initiated disputes, making it an effective option for resolving disputes. The process is also empowering for disputing parties as they are directly engaged in the negotiation of their settlement.
Mediation is an informal process that is less intimidating and more comfortable for parties than a court proceeding. Unlike a court case, it is not necessary to have an attorney represent you during the mediation process. However, some individuals may feel more comfortable with attorney representation.
Mediation is usually a confidential process, which can be beneficial for parties who want to keep the details of their dispute private. Information disclosed during mediation may not be divulged as evidence in any trial or judicial proceeding, except so far as required by law or with the consent of the parties. Decisions made in mediation may also be drafted into a binding legal document, such as Court Orders or a Binding Financial Agreement.
Some factors that may indicate a case is particularly suited to mediation include a willingness by both parties to participate in the process, the possibility that a court decision will not fully address all issues or concerns, the need for the parties to preserve their ongoing relationship, the existence of non-monetary factors that are important to both parties, and the potential for a negotiated outcome that better suits the parties' needs and interests than a court-imposed decision. By considering these factors and working with a trained mediator, families in dispute can often find creative solutions and reach mutually acceptable outcomes that meet their unique needs and circumstances.
If the parties are unable to reach an agreement during the mediation process, the separation process will continue towards a Court hearing in accordance with the Court's directions. While some matters that do not resolve during mediation may settle in the following days as parties come to grips with the likely costs and process going forward, if an agreement is not reached, both parties will need to work with their lawyers to determine their strategies going forward. This may involve making further offers or seeking a determination by the Court.
While the goal of mediation is to reach a settlement, it is important to remember that it does not always result in an agreement. In such cases, we will continue to provide guidance and representation as your matter proceeds through the Court system.
